Real Moments Limited Terms and Conditions


1. Definitions

  • “Client”: The person or entity booking services.
  • “Videographer”: Real Moments Limited.
  • “Event”: The wedding or occasion for which services are booked.
  • “Final Product”: The edited video(s) delivered to the Client.

2. Booking and Payment

  • A booking is confirmed upon receipt of a non-refundable deposit (25% of total fee).
  • The remaining balance is due 10 days before the Event.
  • Late payments may incur 5% monthly interest or result in cancellation of services.
  • Non-payment by the due date permits the Videographer to treat the booking as cancelled.

3. Cancellation & Rescheduling

  • Cancellation by Client:
    • Deposit is non-refundable.
    • If cancellation occurs within 30 days of the Event, 50% of the total fee is payable.
  • Cancellation by Videographer: Full refund of all monies paid.
  • Rescheduling: Subject to availability and may incur additional fees.

4. Force Majeure

The Videographer is not liable for failure to perform due to circumstances beyond reasonable control, including but not limited to:

  • Acts of God, extreme weather, pandemics, government restrictions, or equipment failure.
  • In such cases, the Videographer will offer a rescheduled date or partial/full refund at their discretion.

5. Client Obligations

The Client agrees to:

  • Provide a detailed schedule of the Event in advance.
  • Ensure unobstructed access to key locations (ceremony, reception, etc.).
  • Notify the Videographer of any venue restrictions (e.g., no flash photography).
  • Ensure cooperation from guests/officiants (e.g., no blocking filming).

6. Creative Control & Artistic Licence

  • The Videographer retains full creative control over the Final Product.
  • No unedited/raw footage will be supplied unless agreed in writing (additional fees may apply).
  • The Client is entitled to one round of minor edits; major changes may incur fees.

7. Limitation of Liability

  • In the unlikely event of equipment failure, injury, or loss of footage, liability is limited to a refund of fees paid.
    • The Videographer is not responsible for:
    • Poor lighting/audio due to venue conditions.
    • Missed shots due to unforeseen schedule changes.
    • Guest interference obstructing filming.
  • The Client is liable for any damage to the Videographer’s equipment caused by the Client or their guests.

8. Delivery Timeline

  • Final Product will be delivered within 6 weeks of the Event unless otherwise agreed.
  • Delays due to technical issues, editing workload, or force majeure do not entitle the Client to a refund.

9. Copyright & Usage

  • The Videographer retains copyright of all footage.
  • The Client receives a personal-use licence (non-commercial use only).
  • The Videographer may use clips for promotional purposes unless the Client requests otherwise in writing.

10. Exclusivity

  • The Client agrees not to hire another professional videographer unless agreed in writing.

11. Data Protection & GDPR Compliance

  • Personal data will be processed per the UK GDPR and the Videographer’s Privacy Policy.

12. Governing Law & Disputes

  • These Terms are governed by the laws of England & Wales.
  • Any disputes shall be resolved under the exclusive jurisdiction of the English courts.
